If you do not agree with any of the clauses, stop browsing before using the site. Continued use after a new version has been published amounts to acceptance of the changes made.
Identification
The site is operated by Capitalez Investimentos Alternativos S.A., registered with the National Register of Legal Entities under number 48.291.376/0001-64, with headquarters at Avenida Brigadeiro Faria Lima, 3477, Itaim Bibi, São Paulo - SP, 04538-133.
Questions about these Terms
Write to contato@capitalez.com.br, stating the subject and the points that need to be clarified. Support hours are Monday to Friday, from 9am to 6pm (Brasilia time).
Purpose of the site
The site presents the Capitalez alternative investment platform, discloses information about the companies that raise funds through it and makes supporting documents available to anyone considering taking part in an offering.
The site is a channel for information and for contact. The formalization of any investment depends on the documents specific to each offering, signed by the parties involved under the terms set out in the corresponding offer.
Nature of the information
All published content is for information purposes only. It does not constitute an investment recommendation, a public offering, a proposal, a suggestion or an invitation to subscribe to any instrument, and it does not replace reading the offering documents.
The data presented about each company was supplied by the issuing companies themselves and has not been subject to an independent audit. Projections, revenue estimates and expansion plans describe management expectations, not assured results.
Alternative investments involve the risk of total or partial loss of capital and are not covered by the Credit Guarantee Fund. The full list of risks is set out on the risk notices page.
Permitted and prohibited use
The site may be used freely to consult information and to study. The following practices are not permitted and may compromise the security of the platform or of third parties.
- Do not change the purpose of the content. Reproducing, editing or reselling texts, trademarks, documents and data from the site without prior written authorization is prohibited.
- Do not access restricted areas. Attempting to gain access to third-party accounts, databases or systems without authorization is prohibited, as is circumventing the site's protection mechanisms.
- Do not collect data in an abusive way. Using automated mechanisms to extract content in bulk, to overload the infrastructure or to bypass the platform's terms of use is prohibited.
- Do not post misleading content. Publishing comments, reviews or communications that are false, offensive or that use the Capitalez brand without authorization is prohibited.
Intellectual property
The trademark, the logo, the texts, the visual structure, the code and the documents published on this site belong to Capitalez or to its licensors and are protected by Brazilian law.
Access to the site grants only a limited, non-exclusive, revocable and non-transferable license, for personal use and for the purposes described here. No intellectual property rights are transferred to the user.
No availability warranty
The site is provided as is and as available, with no warranty of continuity, performance or availability. Interruptions due to maintenance, third-party failures, weather events or other causes beyond the control of Capitalez may occur at any time.
There is no time limit for handling support requests or responding to requests. Content may be updated, corrected or removed without prior notice, and Capitalez undertakes no obligation to keep earlier versions.
Limitation of liability
To the fullest extent permitted by applicable law, Capitalez is not liable for damage arising from investment decisions made on the basis of the information on the site, from service unavailability, from third-party content hosted on it or from communication failures with the issuing companies.
This limitation does not cover liability for intent, gross negligence, violation of personality rights, nor cases in which liability cannot be excluded by law, as happens in consumer relations.
Changes to the Terms
Capitalez may change these terms at any time for technical, operational, regulatory or content policy reasons. The current version is always the one published on this page.
Material changes are identified by the version in force of this document. Anyone wishing to receive notices about changes should keep their contact details up to date.
Governing law and venue
These terms are governed by the laws of the Federative Republic of Brazil. Any disputes will be submitted to the courts of the judicial district of São Paulo (São Paulo - SP), with express waiver of any other venue.
Before turning to the judiciary, we recommend contacting our team directly through the support channel in an attempt to reach an administrative solution.
